Terms and Conditions

These Terms and Conditions (“Agreement”) govern your use of the services and products provided by Creative Digital (“we”, “us”, or “our”) and by purchasing our products or services you agree to comply with and be bound by these Terms and Conditions.

  1. Payment Plans

If you choose to purchase a product or service using our split payment/payment plan options, you enter into a Payment Plan Agreement (“Agreement”).

Parties:
This Payment Plan Agreement is between Creative Digital (“Creditor”) and you (“Debtor”). Collectively, these will be referred to as “the Parties”.

Agreement:
By purchasing via a payment plan, the Debtor agrees to pay the Creditor the full amount of the product/service over the selected payment duration.

  • If the Agreement is terminated early, you agree to pay any outstanding amounts to complete the full payment.
  • In the event of failure to meet the payment plan terms, the Creditor reserves the right to declare the full remaining amount immediately due.

Default:
If the Debtor does not meet the agreed payment terms within a reasonable time, the Creditor may:

  • Immediately require the full outstanding amount to be paid.
  • Terminate your access to the product or service without prior notice if payments fail.

Governing Law:
This Agreement is governed by the laws of Victoria, Australia.

Severability:
If any provision is found to be unenforceable, the remaining provisions will remain in effect.

Dispute Resolution:
Any disputes related to this Agreement will be submitted to the Victorian Civil and Administrative Tribunal (VCAT) and be governed by the laws of Victoria.

Confirmation of Terms:
By accepting the terms and conditions during purchase, you confirm your understanding of these arrangements. This confirmation remains valid for future purchases unless otherwise stated.

  1. Conduct Guidelines

We expect all clients, participants, and attendees to adhere to the following conduct guidelines:

Respect and Kindness:
Treat everyone with respect. Aggressive, abusive, or discriminatory behaviour will not be tolerated.

Courteous Communication:
Maintain professionalism in all communications. Disagreements should be handled calmly and respectfully.

Understanding Delays with Support Requests:
We aim to respond promptly, but there may be delays due to varying request volumes. Please be patient. If you don’t receive a response within the expected timeframe, kindly follow up.

Adherence to Instructions:
Follow all instructions provided by our staff and facilitators. Non-compliance may result in removal from any session or service at our discretion.

Consequences of Unacceptable Behaviour

Immediate Removal:
Any participant displaying unacceptable behaviour will be removed immediately from any session, event, or course.

Future Participation:
Participants removed for misconduct may be barred from future offerings at our discretion.

Contract Termination:
We reserve the right to terminate any existing contracts without notice in cases of severe or repeated misconduct.

  1. Reporting and Appeals

Reporting:
Report any inappropriate behaviour to our staff immediately. All reports will be handled confidentially and investigated promptly.

Appeals:
To appeal any decisions related to conduct, submit a written appeal to our management team. All appeals will be addressed in a timely manner.

  1. Community Guidelines

We expect all participants to uphold the following community guidelines:

  • Respect Others: Treat everyone courteously and with consideration.
  • Be Inclusive: Create a welcoming and valued environment for all.
  • Communicate Constructively: Engage respectfully and provide feedback in a supportive manner.
  • Practice Patience: Understand delays and miscommunications,  and show patience.
  • Follow Directions: Adhere to instructions from our team. Ask questions respectfully at appropriate times.
  • Maintain Confidentiality: Respect the privacy of others and protect personal or sensitive information shared in confidence.
  • Resolve Conflicts Respectfully: Address conflicts calmly and work toward a resolution.
  • Commit to Safety: Follow safety protocols to ensure a secure environment for everyone.

  1. Miscellaneous

Force Majeure:
We are not liable for any delays or failures in performance due to events beyond our control, including but not limited to natural disasters, strikes, or government actions.

Intellectual Property:
All content, including text, graphics, and logos, is the property of Creative Digital and is protected by intellectual property laws. You may not copy, reproduce, or distribute any content without permission.

Amendments:
We reserve the right to update or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website.

Limitation of Liability:
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits or revenue arising from your use of our services or products.
